What information is required to get a quote?

We only work through licensed insurance brokers. A completed proposal form (available under the Downloads tab) is ideal. If you don’t have one yet, start with:

 

  • Insured’s name and business description.
  • Website address and estimated turnover (incl. export splits).
  • List of past liability claims/incidents.
  • Trading contract terms.
  • Indemnity limits and cover required. 
  • Any supporting risk information (e.g., risk protocols, SOPs, surveys).

Where do liability claims come from?

Claims generally come from: 

 

  • Third parties with whom the client enters into a contract.
  • Third parties to whom injury or damage has been caused by the Insured.
  • Depending on the insured’s type of operation, claims can come from anyone, anywhere in the world. 

Does the Insured only need Products Liability cover if they manufacture a product?

No. The South African Consumer Protection Act (CPA) can hold any party in the supply chain legally responsible for harm caused by a product, this includes distributors, wholesalers, suppliers, retailers, importers, distributors, and retailers. The Santam product liability cover caters for any business who designs, formulate, specifies, manufactured, constructs, installs, sells, supplies, distributes, treats, services, alters or repairs tangible property.

Can cover extend to operations outside South Africa?

Yes, the policy includes an extension for African operations outside South Africa. However, compliance with local regulations is essential to avoid fines or claim issues, as many African countries restrict non-admitted insurance.

Will the liability policy cover the Insured’s own financial loss?

No. Liability insurance protects against third-party claims, not the Insured’s own losses.

Does my policy cover contracts I enter into?

The Broadform Liability policy covers both delictual and some contractual liability, but exclusions apply. For example, fines and penalties agreed to in a contract may not be covered.

Should incidents be reported even if the Insured isn’t liable?

Yes. All incidents related to business operations should be reported. Our claims team will assess and guide next steps, even if the Insured believes they aren’t at fault.
