What information is required to get a quote?
Santam works exclusively through licensed insurance brokers. A completed proposal form is required and can be downloaded from the Downloads section of this page. In addition, please provide:
How many deductibles do clients have to pay?
Deductibles apply per occurrence. If the insured has deductible infill cover under an annual policy, this may reduce the deductible applicable to the Single Project PI policy.
What happens to the policy if someone else goes insolvent?
The policy remains in force. The first-named insured retains the right to appoint a replacement to complete the work.
What if liability between the parties is contractually limited (e.g. twice the fees)?
The Single Project PI policy includes a No Contractual Limitation of Liability clause, which means contractual caps are disregarded, the policy will respond up to its full limit of indemnity.
What if the policy’s limit of indemnity is eroded by other claims?
The consultant must declare the project under their Annual PI policy. If the limit under the Single Project policy is eroded, the Annual policy may provide supplementary coverage.
What happens if multiple professionals are sued for the same error?
Each professional will be assessed individually. Liability will only attach to those found responsible for the error or omission.
Will the insurer share sensitive project information with other parties?
No. Confidentiality is a priority. A legal team and project team will be appointed and will operate independently to ensure client confidentiality is preserved.
Who does the broker represent in a Single Project PI policy?
Typically, brokers act on behalf of the employer or project owner, who arranges the policy to cover all professionals. However, it is recommended that consultants and their individual brokers engage directly with Santam to ensure alignment.
What if I’m held liable but didn’t make a mistake?
The policy provides defence costs cover. It will respond to fund legal defence against allegations of negligence, even if the claim proves to be unfounded.
What if a professional refuses to claim on the policy?
In such cases, the third party (project owner) must pursue legal action against the professional. The policy can only respond if the professional triggers it.
What if one insured party breaches the policy conditions?
Only the professional responsible for the breach will be excluded from cover. The rights of other insured parties under the policy remain unaffected.
